Welcome to Heavenly Sites. These Terms of Service ("Terms") govern your use of our website design and development services. By engaging our services, you agree to be bound by these Terms. Please read them carefully.
By accessing our website, submitting a project inquiry, or entering into a service agreement with Heavenly Sites, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services. These Terms apply to all visitors, clients, and users of our services.
Heavenly Sites provides custom website design and development services tailored to each client's business needs. Our services include, but are not limited to, custom website design, responsive development, content integration, basic SEO setup, and optional ongoing maintenance plans. Each project is uniquely built to reflect the client's brand and goals. Specific deliverables and timelines will be outlined in a project agreement or proposal.
Our standard website build fee is a one-time payment of $500, which covers the complete design and development of your website. A 50% deposit is required to begin work, with the remaining balance due upon project completion and prior to final delivery.
Optional monthly maintenance plans are available at three tiers: $10/month (basic updates and monitoring), $75/month (standard maintenance including content updates and security), and $100/month (premium maintenance including priority support, ongoing optimization, and analytics). Maintenance fees are billed monthly and either party can cancel at any time. All payments are non-refundable once work has commenced.
To ensure timely project completion, clients agree to provide all necessary content, including text, images, logos, and branding materials, in a timely manner. Clients are responsible for reviewing drafts and providing feedback within a reasonable timeframe (typically 3–5 business days). Delays in providing content or feedback may result in project timeline extensions. Clients are also responsible for the accuracy and legality of all materials provided to Heavenly Sites for use on their website.
Each project includes up to two rounds of revisions to ensure client satisfaction. Additional revisions beyond this scope may incur additional charges at our standard hourly rate. Final delivery of the completed website will occur upon receipt of full payment. Websites can be built anywhere from a single day up to two weeks, depending on the customer and various factors such as scope, complexity, content readiness, and revisions, and the estimated timeline will be confirmed in the project agreement.
Full ownership of the completed website, including all custom code, design assets, and content created by Heavenly Sites, transfers to the client upon receipt of full payment. Prior to full payment, Heavenly Sites retains all rights to the work. Third-party assets, such as fonts, stock images, or licensed plugins, remain subject to their respective licenses. Heavenly Sites reserves the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing.
Heavenly Sites provides services on an "as-is" basis and makes no warranties, express or implied, regarding uninterrupted service, error-free operation, or specific business outcomes. In no event shall Heavenly Sites be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to lost profits, data loss, or business interruption. Our total liability for any claim shall not exceed the total amount paid by the client for the specific service in question.
Either party may terminate a project agreement with written notice. If the client terminates the project after work has commenced, the initial deposit is non-refundable, and any additional work completed will be billed at our standard rate. Heavenly Sites reserves the right to terminate services if the client breaches these Terms, fails to make timely payments, or engages in unlawful or abusive conduct. Maintenance plans may be cancelled by either party at any time.
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of Maryland.
Heavenly Sites reserves the right to update or modify these Terms at any time. Any changes will be posted on this page with a revised "Last updated" date. Continued use of our services after any modifications constitutes acceptance of the updated Terms. We encourage clients to review these Terms periodically to stay informed of any changes.
Heavenly Sites is not responsible for outages, security incidents, software bugs, domain registrar issues, hosting failures, email delivery problems, plugin updates, or other issues caused by third-party services or providers.
